Welcome to Smart Budget. By downloading, installing, or using our mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

1. Acceptance of Terms

By accessing or using Smart Budget, you agree to these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the App.

2. Description of Service

Smart Budget is a personal finance application that helps you:

Track income and expenses manually or via voice input
Set up recurring transactions (daily, weekly, biweekly, monthly, or yearly)
Scan and process receipts using AI
Import bank statements (PDF and CSV)
Set and manage monthly and special budgets
Get AI-powered financial insights and chat-based advice
Track spending across 30+ currencies with live exchange rates
Share budgets with household members in real time
View budget summaries via home screen widgets
Export financial data in CSV, PDF, and JSON formats

3. Account Registration

To use Smart Budget, you must create an account using Sign in with Apple. You are responsible for:

Maintaining the security of your account
All activities that occur under your account
Notifying us immediately of any unauthorized use

4. Subscriptions and Payments

4.1 Free and Premium Features

Smart Budget offers both free features and a Premium subscription. Free features include manual transaction entry, monthly budgets, up to 3 special budgets, basic charts, data export, and multi-currency support. Premium features include receipt scanning, voice input, AI chat and financial tips, bank statement import, household creation and management, and unlimited special budgets.

4.2 Subscription Terms

Premium is available as a monthly or annual subscription; pricing varies by region and is displayed in the App before purchase
Subscriptions are billed through your Apple ID via the App Store
Payment is charged at confirmation of purchase
Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
You can manage and cancel subscriptions in your device's Settings > Apple ID > Subscriptions
Premium is per-user; each household member requires their own subscription to access premium features

4.3 Refunds

Refund requests are handled by Apple according to their App Store policies. Please contact Apple Support for refund inquiries.

5. User Content and Data

5.1 Your Data

You retain ownership of all financial data, receipts, bank statements, and other content you enter or upload into the App. We do not claim any ownership rights over your content.

5.2 Data Accuracy

You are responsible for the accuracy of information you enter. Smart Budget provides tools to help manage your finances but does not guarantee the accuracy of AI-processed data such as receipt scans, voice input transcriptions, bank statement imports, or automatic categorizations. You should always review AI-generated results before saving them.

5.3 Backup Responsibility

The App provides automatic backups (every 12 hours) and manual backup/export features. You are responsible for maintaining your own backups of important financial data. We are not liable for data loss due to device failure, account deletion, or other causes.

6. Household Sharing

If you use household sharing features:

You may invite up to 6 members to share a household using a 6-digit invite code
All transactions, budgets, and receipt images are shared and visible to all household members
The household creator (admin) can remove members at any time
Each member needs their own Premium subscription to access premium features; free users can join a household but cannot use AI features
Leaving or being removed from a household revokes access to shared data

7. Recurring Transactions

Smart Budget allows you to create recurring transactions that automatically generate on schedule. You acknowledge that:

Recurring transactions are generated when you open the App; they are not generated in the background while the App is closed
Editing a recurring transaction offers scope options ("this one only" or "this and all future"); choose carefully as changes to future transactions cannot be individually undone
Deleting all instances of a recurring transaction permanently removes the template and all generated transactions

8. Widgets

Smart Budget provides home screen widgets that display budget progress and spending summaries. Widget data is refreshed periodically (approximately every 30 minutes) and may not always reflect the most recent transactions. Widgets rely on data shared locally between the App and the widget extension via an App Group container on your device.

9. Currency and Exchange Rates

Smart Budget supports 30+ currencies and displays amounts in your preferred currency using live exchange rates sourced from the European Central Bank via a third-party service (Frankfurter.app). Exchange rates are indicative and may not reflect real-time market rates. We are not responsible for any financial decisions made based on displayed exchange rates.

10. Acceptable Use

You agree not to:

Use the App for any illegal purpose
Attempt to reverse engineer or extract source code
Interfere with or disrupt the App's functionality or servers
Use automated systems or bots to access the App or its APIs
Circumvent rate limits or usage restrictions
Share your account credentials with others
Upload malicious files disguised as receipts or bank statements

11. AI Features

Smart Budget uses artificial intelligence (powered by OpenAI) for receipt scanning, transaction categorization, financial chat, savings tips, voice input parsing, and bank statement import. You acknowledge that:

AI-generated results may not always be accurate and should be reviewed before use
You should verify important financial information independently
AI features require an active internet connection and a Premium subscription
AI features are subject to rate limits (20 requests per minute per user)
AI processing is subject to our Privacy Policy
AI features should not be relied upon as professional financial, tax, or legal advice

12. Service Limits

Receipt image uploads are limited to 5 MB per image (JPEG format)
AI chat history is limited to 20 messages per conversation
AI requests are rate-limited to 20 per minute per user
Free accounts are limited to 3 special budgets
Households may have up to 6 members

13. Disclaimer of Warranties

Smart Budget is provided "as is" without warranties of any kind, whether express or implied. We do not guarantee that:

The App will be uninterrupted or error-free
AI features will be 100% accurate
Exchange rates will be current or accurate
Data sync will occur in real time under all network conditions
The App will meet all your requirements

Smart Budget is not a substitute for professional financial advice. Consult a qualified financial advisor for important financial decisions.

14. Limitation of Liability

To the maximum extent permitted by law, Smart Budget and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or data, arising from your use of the App. This includes, without limitation, damages arising from inaccurate AI processing, exchange rate discrepancies, data sync failures, or reliance on information provided by the App.

15. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes by updating the "Last updated" date and, where appropriate, through in-app notifications. Continued use of the App after changes constitutes acceptance of the new Terms.

16. Termination

We may suspend or terminate your access to the App at any time for violation of these Terms. You may stop using the App at any time. Upon termination, you may export your data using the App's export feature before deleting your account.

17. Governing Law

These Terms are governed by the laws of Switzerland. Any disputes shall be resolved in the courts of Switzerland.
